Former New Hampshire Gov. Craig Benson had made an agreement with former HHS Secretary Tommy Thompson resolving issues from an audit of the state’s Medicaid practices in 2004, including using Medicaid Disproportionate Share Hospital money to refund Medicaid enhancement taxes that 26 hospitals paid. However, the Office of Inspector General disputed the agreement and sought repayment of the $35 million.
Several New Hampshire hospitals have recently filed amended tax returns with the state to recover alleged overpayments of $51 million to the Medicaid enhancement tax.
