David Ketroser, MD, JD, filed the whisteblower suit in 2007, and the Department of Justice intervened in September 2010. The suit claimed Rochester, Minn.-based Mayo knowingly billed Medicare, Medicaid and other federal health programs for the preparation and examination of permanent human-tissue slides that Mayo had never made nor examined.
The settlement reflects a payment of $263,000 that Mayo has already paid the government following a subpoena, as well as an additional $1 million Mayo agreed to pay.
