Southeast Volusia oversees Bert Fish Medical Center in New Smyrna Beach, Fla., which merged with Florida Hospital in July 2010. In February 2011, a Circuit Court judge overturned the $81 million merger due to Sunshine law violations by the public hospital. The violations were filed by the Bert Fish Foundation, which owned the hospital before gifting it to the hospital district in 1966, according to the report.
The hospital district’s suit alleges it received improper advice from its former attorney which led to not making the merger meetings public.
