The hearing, granted Oct. 3 by the same judge who presided over Ms. Holmes’ criminal-fraud trial, is set for Oct. 17, the same day Ms. Holmes’ sentencing was scheduled.
If the judge doesn’t grant a new trial, Ms. Holmes’ sentencing would be pushed back until November.
The post-trial hearing comes after Ms. Holmes’ defense team alleged that there is new evidence indicating that the government presented misleading testimony regarding former Theranos lab director Adam Rosendorff.
According to a document filed by Ms. Holmes’ defense team, the prosecutors in the case “made things sound worse than they were when he was up on the stand during his testimony.”
