Infinity Diagnostics lab in Ventnor, N.J., was shut down after federal agents raided it in December 2020. The business is accused of selling and administering finger-stick and antibody tests that could diagnose COVID-19, although the tests could not, according to the report.
Those who sought COVID-19 testing at the facility were urged to get retested.
A proposed class action lawsuit over the tests received preliminary court approval Nov. 5. Stephen Denittis, the plaintiffs’ attorney, said he believes about 400 people were affected. A proposed settlement calls for refunds of $37.50 to $75 per person, depending on whether they can provide proof of being tested at the lab.
Infinity Diagnostics denies wrongdoing, according to the report. If the settlement is approved at a Jan. 21 court hearing, the lab would have to issue payments within 60 to 90 days.
