The Federal Trade Commission is making its oral argument in its appeal regarding a June decision that dismissed the FTC’s claim of jurisdiction over the merger of Albany, Ga.-based Phoebe Putney Memorial Hospital and Palmyra Medical Center, according to a Fox 31 report.
In a statement, Phoebe said the organization maintains its position on the Hospital Authority of Albany-Dougherty County’s right to buy Palmyra without federal intervention.
In June, U.S. District Court Judge Louis Sands ruled that the Hospital Authority of Albany-Dougherty County was immune from attempts by the FTC to block the transaction. The FTC is appealing that ruling, contending that the Hospital Authority approved the $195 million deal without considering possible antitrust issues, particularly that the acquisition could result in a monopoly and increased prices.
The appeal is being made in the 11th Circuit Court of Appeals in Atlanta.
