Garden County Health Services, a rural emergency hospital in Oshkosh, Neb., has filed for Chapter 9 bankruptcy protection.
Five things to know:
1. The filing gives the organization a legal framework to address financial challenges while continuing to serve patients, according to an Aug. 19 statement from CEO Samuel Pennington that was posted on the organization’s Facebook page.
2. The voluntary petition was filed Aug. 18, according to court documents reviewed by Becker’s.
3. Garden County Health Services’ hospital, EMS, rural health clinic and long-term care operations will continue without interruption throughout the process, Mr. Pennington said. Patients will see no changes in access to care, and employees will continue serving the community.
“This decision was not made lightly,” Mr. Pennington said. “After careful evaluation with legal and financial counsel, we determined that a Chapter 9 filing is the best path to protect essential healthcare services, address our financial obligations in an orderly manner, and position Garden County Health Services for long-term sustainability.”
4. Garden County Health Services transitioned to a rural emergency hospital in January, Nebraska Public Media reported Aug. 19. The hospital was affiliated with Regional West until July 2024, and Mr. Pennington said certain contracts carried over from that partnership were not sustainable going forward.
“We’re doing some right-sizing with this,” he told Nebraska Public Media.
5. Chapter 9 of the U.S. Bankruptcy Code is designed to help eligible public entities reorganize debt while maintaining essential public services. Garden County Health Services will continue working with creditors, stakeholders and community partners throughout the restructuring process, Mr. Pennington said.
He added that the hospital remains committed to providing high-quality healthcare services to residents, and additional information will be shared as the process moves forward.
