KPMG attempts to get Singing River lawsuit tossed

National accounting firm KPMG is trying to get the court to throw out a lawsuit it is facing, which was filed by Pascagoula, Miss.-based Singing River Health System, according to a Sun Herald report.

The lawsuit, filed in January in federal district court, claims KPMG made significant auditing errors, including "masking" the underfunding of Singing River's pension plan. The lawsuit includes claims for breach of contract, professional malpractice and negligence for allegedly committing "egregious failures in auditing Singing River's financial statements," which led to an $88 million adjustment.

KPMG has filed a motion to dismiss the lawsuit in district court, claiming the lawsuit doesn't belong in federal court. KPMG is also claiming that under the contract it has with Singing River disputes are to be negotiated through arbitration, according to the report.
