Alere shares climbed 4.4 percent to $37.74, the company’s biggest gain since Sept. 7. when shares rose 5 percent.

Abbott Laboratories requested the documents as part of a breach-of-contract lawsuit against Alere on account of its operations and billing practices Nov. 3, according to TheStreet. Alere had previously filed a lawsuit against the pharmaceutical company in August claiming Abbott Laboratories’ executives attempted to stymie the deal. The lawsuit is still pending.

Alere officials said they consider the lawsuit to be “entirely without merit,” but agreed to turn over the documents to help close the deal as quickly as possible, according to Chicago Tribune.
