The move is aimed to override a three-judge panel’s December 2012 ruling that an injunction placed on the CMS-approved cuts should be lifted. The petition requests the case be reviewed en banc, meaning in this instance that 11 judges would hear the case.
Supporters of the cuts say they would save the state $431 million per year, but providers and healthcare activists argue it would shrink access to care for poor individuals.
