Specifically, the AHA praised CMS for not modifying EMTALA’s application to critical access hospital inpatients and hospitals with specialized capabilities.
EMTALA requires hospitals participating in Medicare to provide a medical screening examination to patients with an emergency medical condition regardless of their ability to pay. Last year, CMS proposed expanding the law to apply to certain hospital inpatients.
In January, CMS concluded that the current regulations are sufficient.
