Robert F. Kennedy Jr. and fellow lawyer Michael Sussman on July 10 filed a lawsuit against New York on behalf of 55 families, claiming the new law is unconstitutional.
Democratic New York Gov. Andrew Cuomo signed the bill into law June 13 as part of a larger effort to control two major measles outbreaks in the state.
In July, a judge denied Mr. Sussman’s request for a temporary restraining order to block the law. The case now sits in Albany County Supreme Court. Acting Justice Denise Hartman will decide whether to grant a temporary injunction to delay the law from taking effect, according to WSJ.
Justice Hartman heard oral arguments Aug. 14 but has not yet shared her decision. Her ruling will affect about 26,000 New York children who previously received religious exemptions to vaccine requirements.
