Fallon Health's request to stop ex-CFO from working at Aetna rejected

A judge tossed a request from nonprofit insurer Fallon Health to halt its former CFO from working for rival Aetna, according to the Telegram & Gazette.

In a June 6 order, Worcester Superior Court Judge Janet Kenton-Walker denied Fallon's request for a preliminary injunction against its ex-CFO Kevin Grozio. The judge said the order didn't show Mr. Grozio's new job with Aetna breached a 2017 employee contract he had with Fallon. Under the contract, Mr. Grozio agreed to not compete against Fallon for a year after taking a new job nor share or use Fallon's confidential business information.

When Mr. Grozio announced plans to leave Fallon for a CFO position with Aetna's Medicare Advantage division in April, Fallon argued he had access to all of the insurer's confidential information. However, the judge said Mr. Grozio wouldn't be competing directly with Fallon during his first year at Aetna, and he could suffer harm if not allowed to take the position, according to the Telegram & Gazette.

Fallon did not return the Telegram & Gazette's request for comment on the case. In an emailed statement to the publication, Aetna said it is "pleased with the judge's decision in this matter."
