Wisconsin court rules cap on medical malpractice payouts unconstitutional

A three-judge panel of Wisconsin’s First District Court of Appeals ruled Wednesday that the state’s $750,000 cap on medical malpractice payouts is unconstitutional, according to the Milwaukee Journal Sentinel.

“We conclude that the statutory cap on non-economic damages is unconstitutional on its face,” wrote Judge Joan Kessler in the court’s 19-page opinion, according to the report.

Wisconsin law caps non-economic damages in medical malpractice cases; however, there is no maximum amount on economic damages such as medical costs, according to the report.

The case is expected to go to the Wisconsin Supreme Court.
