David Guerrero Jr. previously pleaded guilty to referring patients to pharmacies owned by his co-defendant, Alexander Shister, for expensive compound pain creams in exchange for kickbacks, according to a Nov. 21 Justice Department news release.

The Justice Department said although Mr. Guerrero is not a licensed medical provider, he used his access to private medical records at the clinics to identify patients who could need pain creams and then ordered the creams from Mr. Shister’s pharmacies without the patients’ knowledge or consent.

Mr. Shister previously pleaded guilty to his role in the scheme and is scheduled to be sentenced Jan. 13.
