In the ruling last week, Summit County Judge Lynne Callahan also upheld a jury verdict awarding Summa $906,464 in compensatory damages. The verdict was from a July trial on a breach of management services agreement with WRHP, according to the report.
The physician group co-owns Western Reserve Hospital with Summa. WRHP voted to eliminate Summa from the joint venture that controls the hospital in November 2014 and take over Summa’s 40 percent stake because it was displeased the health system sold a minority stake in the hospital to an outside group. Summa sued WRHP in February 2015, claiming its participation was wrongly terminated.
WRHP requested a new court judgment or new trial on the case, which was denied by Judge Callahan. The court ruling may give Summa the ability to sell its stake in the hospital, according to the report.
