Obama administration appeals PPACA subsidy case

The Obama administration has asked for a rehearing in a case that held tax subsidies to low- and middle-income Americans may not be provided in states that use health insurance exchanges run by the federal government, according to a Politico report.

On July 22, a three-judge panel of the D.C. Circuit Court of Appeals ruled tax subsidies may not be provided in states that did not establish their own exchanges. On the same day, a three-judge panel from the Fourth U.S. Circuit Court of Appeals unanimously held subsidies for health insurance were allowed under the Patient Protection and Affordable Care Act in all states, even in states that use federallyrun health insurance exchanges.

The administration is seeking a rehearing on the D.C. Circuit's decision. If the request is granted, the case would be reheard by13 judges, including two judges involved in the initial decision.
