New York health system loses eminent domain legal battle

The New York State Supreme Court, appellate division, ruled against Utica-based Mohawk Valley Health System's request to use eminent domain to procure a parcel of land as part of the construction of a medical office building, The Observer-Dispatch reported Dec. 28.

The Oneida County Industrial Development Authority had attempted to use eminent domain to obtain the land on behalf of the health system. 

Bowers Development, a real estate development company and the petitioner in the case, had signed a purchase agreement for the property before the use of eminent domain was discussed.

The land parcel, currently occupied by J.P. O'Brien Plumbing and Heating, would have been used by the hospital to construct a parking lot for the medical office building.
