New Bill Would Help Ensure Stark Law Applies to Medicaid

The Medicaid Self-Referral Act of 2014, introduced by Rep. Jim McDermott (D-Wash.), seeks to provide clarification on the Stark Law and how it applies to Medicaid-designated health services.

Congress intended the Stark Law to apply to compensation arrangements for Medicaid services just as it does for Medicare services. However, because of confusion surrounding how to apply the Stark Law to Medicaid health services, the law has been mostly reserved for cases involving Medicare fraud, according to the news release. 

"The legislation is about protecting taxpayer dollars," said Rep. McDermott in the news release. "This will likely result in millions of dollars in overpayments being returned to the Medicaid program."
