Justice Department Won’t Challenge New York Pay-for-Performance Program

The Department of Justice has said it will not challenge New York City Health and Hospitals Corporation’s proposal to tie physicians’ pay to performance, noting the program should not adversely affect competition.

The pay-for-performance agreement covers more than 3,500 physicians who are affiliated with the municipal corporation’s 11 hospitals. Physicians will receive bonus payments if they meet a series of six standards, including reducing readmission rates for certain conditions and meeting national standards for patient satisfaction.

If those specified metrics are met, up to $59 million in bonus payments will be divided between the physician groups over three years.

The DOJ said the program should not hurt competition, since hospitals will “not exchange any confidential information and because each hospital will independently determine physician gainsharing amounts,” according to the release.
