The rules at issue are contained in Hills and Dales General Hospital’s values and standards of behavior policy. The rules prohibit negative comments about fellow team members and prohibit employees from engaging in or listening to negativity.
The NLRB concluded the rules were too broad and could be interpreted by employees as prohibiting activity protected by Section 7 of the National Labor Relations Act, which gives employees the right to self-organization; to form, join or assist labor organizations; to bargain collectively through representatives of their own choosing and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection.
The hospital was ordered to revise or rescind the rules prohibiting negativity within 14 days.
