The American Hospital Association and a coalition of healthcare groups, including 340B Health, the Nebraska Hospital Association and the American Society of Health-System Pharmacists, filed a brief in support of Nebraska’s new law reinforcing protections for the federal 340B drug discount program.

The law requires drug manufacturers to ship 340B-priced medications to hospitals’ contract pharmacies, according to court documents reviewed by Becker’s.

In the brief, filed in the U.S. District Court for the District of Nebraska, the groups argue that the law addresses a gap in the original 340B statute, which does not specify drug delivery requirements.

The brief also emphasized the importance of contract pharmacy arrangements, which account for a substantial share of 340B-related savings — resources the groups said are essential to sustaining services such as cancer treatment, behavioral healthcare and affordable prescriptions.
