On Friday, the Justice Department filed a brief responding to a motion to dismiss the allegations by the health system. In September, the DOJ intervened in a 2009 whistleblower suit against Halifax that claimed the system’s financial agreements with the physicians were more than fair market value, were not commercially reasonable or took into consideration the volume or value of the physicians’ referrals.
Halifax’s attorney told the Daytona Beach News-Journal that the health system plans to reply to the DOJ’s brief and is eager to present oral arguments in the case.
