In 2009, Scripps acquired Sharp Mission Park Medical Group, a practice of 65 physicians that had previously referred the majority of their patients to Tri-City Medical Center.
Tri-City claimed that since the acquisition, “Scripps has steered patients living in the District to Scripps facilities in Encinitas, and as far away as Chula Vista, adversely affecting patients and their care,” according to the report.
Scripps tried to handle the case in arbitration, but the Fourth District Court of Appeal upheld a trial court ruling that Tri-City’s anticompetitive claims are not subject to arbitration.
