Ms. Swanson’s suit claims Chicago-based Accretive improperly sought payments at patients’ bedsides and in hospital emergency departments in two Minnesota hospitals. She also alleges that Accretive debt collectors did not consistently disclose their roles.
Accretive is asking U.S. District Judge Richard H. Kyle in St. Paul, Minn., to throw out the suit, calling some of Ms. Swanson’s allegations “factually baseless and legally indefensible.”
The company also wrote in its dismissal request that “the attorney general orchestrated a nationwide media campaign against Accretive Health, giving numerous television and print interviews to trumpet her release of a so-called ‘compliance review.'”
