6 Findings on Recently Unsealed False Claims Act Cases

Since March, the government has unsealed 58 cases filed under the qui tam, or whistle-blower, provision of the False Claims Act, according to a National Law Review report.

The report made the following findings regarding the recently unsealed claims cases:

  • 75 percent of the whistle-blowers were current or former employees of the defendants named in the lawsuits
  • 33 of the cases were filed in 2012 or later

  • The federal government intervened in 29 percent of the cases

  • 25 percent of the cases contained claims brought under both the federal False Claims Act and similar state statutes

  • 45 percent of the cases were filed against healthcare providers, including physical therapists and hospice providers

  • 10 percent of the cases were filed against laboratory companies and diagnostic imaging companies
