U.S. District Court Judge Reed O’Connor ruled on Dec. 14 that key portions of the ACA violate the U.S. Constitution and that the law cannot stand on its own after Congress repealed the ACA’s individual mandate that imposed a tax penalty on uninsured consumers last December.
President Trump tweeted his support shortly after Mr. O’Connor’s ruling, urging Congress to pass new legislation that provides “great healthcare and protects pre-existing conditions.”
While the Trump administration attempted to repeal and replace the ACA several times during the past two years, the effort failed to achieve majority support in the Senate. However, the administration has successfully dismantled key aspects of the law, which may have contributed to the 11.7 percent decline in enrollment between the 2017 and 2018 enrollment periods, according to CMS data cited by CNBC.
