Wake Forest Baptist Medical Center in Winston-Salem, N.C., is suing a former employee who filed a whistleblower complaint that Wake Forest Baptist was receiving reimbursement rate overpayments from the State Health Plan, according to a Winston-Salem Journal report.
The hospital will keep the $1.34 million in reimbursement overpayments since it complied with the terms of the State Health Plan’s contract. It is suing Joseph Vincoli, however, for “unjustified, vindictive, malicious and gratuitous actions” after he alerted state officials of the valid billing issues in Jan. 2009.
The hospital’s suit claims Mr. Vincoli, a former managed care director at the hospital, breached their confidential settlement by contacting their plan and other state agencies and providing disparaging and/or confidential information, according to the report.
Mr. Vincoli’s employment was terminated by the hospital in 2007. The hospital is suing him for damages of more than $10,000 to recover the more than $10,000 it paid Mr. Vincoli in a May 2008 confidential settlement agreement, and to prevent him from further breaches of the agreement.
