Judge Dismisses Age Discrimination Suit by Former Battle Creek Health CEO

A judge has dismissed an age discrimination suit against Battle Creek (Mich.) Health by its former CEO Patrick Garrett but awarded Mr. Garrett nine months of severance pay estimated at $321,000, according to a Battle Creek Enquirer report.

Mr. Garret left Battle Creek in 2008 and its parent Novi, Mich.-based Trinity Health in 2010. He was seeking 19 months of severance pay. His age discrimination suit sought an unspecified amount, according to the report.
The discrimination suit alleged that Mr. Garrett was essentially “put…out to pasture” because of his age, according to Mr. Garrett’s attorney. The suit also alleged Michael Slubowski, then president of hospital and health networks for Trinity,
inquired about Mr. Garret’s age several times. Mr. Slubowski argued he and Mr. Garrett had been discussing his retirement with the health system, but the former CEO denied the allegation.

The judge found no evidence of age discrimination and dismissed the suit.
