In its original complaint, Wauwatosa argued Wheaton Franciscan Healthcare’s outpatient clinics should not be exempt from paying property taxes to the city, according to the news report. However, the non-profit healthcare system countered its outpatient clinics are an extension of its St. Joseph facility in Milwaukee.
The case has since bounced back and forth among the lower courts before finally landing in the high court, where it ruled 6-1 in favor of Wheaton Franciscan. As a result of the high court’s ruling, approximately $8.5 million in paid property taxes plus interest will be repaid to Wheaton Franciscan.
