EMTALA Regulations for Specialized Hospitals Remain Unchanged

CMS will not propose any changes to the current Emergency Medical Treatment and Labor Act, which requires hospitals to stabilize all patients that present with an emergency medical condition regardless of their ability to pay, according to an AHA News Now report.

CMS is providing an additional 60 days for comment on how EMTALA is applied to specialized facilities, and the AHA plans to urge the law remain unchanged, according to the report.

CMS had previously considered expanding the application of the EMTALA to inpatients in need of transfers to specialized facilities. The AHA opposed the expansion, which could have required specialized hospitals to accept transfer patients who could not be stabilized at their current hospital.
