Judge William Horrick of U.S. District Court for the Northern District of California granted part of the defendant’s motion to dismiss May 8 and gave the plaintiff until May 30 to amend its breach-of-contract claim.
A patient known as Jane Doe had filed the class-action complaint against the Regents of the University of California in February over its alleged use of the Meta Pixel consumer-tracking technology.
In their motion to dismiss, the regents argued that as a public entity the plaintiff’s “unjust enrichment” claims were invalid. Several health systems around the country are fighting similar lawsuits alleging they shared patient data with tech companies via the tracking tools.
