The OIG, working in conjunction with the Department of Justice, sent NYU Langone a subpoena in January requesting information related to the hospital’s Medicare cost reports for 2010 through 2019. The agency is investigating “possible false or otherwise improper claims” that the hospital submitted to Medicare, according to financial documents. The hospital said the investigation relates to Medicare payments made to NYU Langone as reimbursement for indirect graduate medical education expenses.

The subpoena requests data and documents used to calculate the hospital’s indirect medical education expense adjustment factor, which is partially based on the number of residents in accredited training programs to available inpatient beds at NYU Langone as reported on the hospital’s Medicare cost report.

“The investigation is at a preliminary phase, and no demand for repayment has been received,” states the financial documents. The hospital said it cannot predict the outcome of the investigation.
