Judge Delays Full Disclosure of West Penn Physician Compensation Agreement

U.S. District Court Judge Arthur Schwab, who ordered last week that the details of health insurer’s proposed acquisition of Pittsburgh-based West Penn Allegheny Health System be made public, delayed the release of an uncensored portion of their agreement, according to a Pittsburgh Post-Gazette report.

WPAHS argued that it does not want to disclose a portion of the deal that lists names and salaries of physicians, according to the report. Some physicians earn more than $500,000 have contracts that earn more than $900,000.

Judge Schwab has ordered WPAHS’ attorneys to show University of Pittsburgh Medical Center attorneys and the Pittsburgh Post-Gazette the relevant portions of the deal before noon on Jan. 9. The parties will then decide what pieces of information will be public. Two years ago, WPAHS filed a lawsuit alleging UPMC and Highmark conspired together to block competition. Since then, Highmark proposed to acquire WPAHS for $475 million, and WPAHS dropped Highmark from the lawsuit. UPMC is now the only defendant named in the lawsuit.
