Boston residents filed the appeal with the Health Facilities Appeals Board Nov. 11.
The complaint alleges the Commonwealth’s review of the hospital’s determination of need application “is fatally flawed,” according to documents obtained by Boston Business Journal.
Specifically, opponents argue the hospital did not provide alternatives to its current plan and that conditions of approval for the expansion give the hospital “too many loopholes” to avoid penalties if costs are higher than anticipated.
“Our appeal is designed to stop this massive and unnecessary construction project, which will increase healthcare costs, reduce competition and wipe out an essential natural, historic and human resource that has brought solace to thousands of patients, families and staff at Boston Children’s Hospital,” Greg McGregor, lawyer for the Anne Gamble Ten Taxpayer Group, said in a statement.
