Houston physician gets 5-year prison term for fraud

Houston physician Warren Daily, MD, has been sentenced to 63 months in prison for his role in a healthcare fraud and kickback scheme, according to the Department of Justice.

In March, a federal jury convicted Dr. Daily of conspiracy to commit healthcare fraud, making false statements related to healthcare matters and paying and receiving kickbacks.

According to evidence presented at trial, Dr. Daily defrauded Medicare from 2009 through 2012 by authorizing Medicare beneficiaries for home healthcare when such services were not needed. The evidence showed Dr. Daily signed Medicare authorization forms in exchange for a monthly flat fee from the owner of a home healthcare company. Medicare paid the home health owner about $913,620 for services Dr. Daily referred.

In addition to his prison term, Dr. Daily was ordered to pay $913,620 in restitution.
