Judge Denies UPMC's Request to Halt Antitrust Case; Discovery Period Begins

Lawsuits between Pittsburgh-based West Penn Allegheny Health System against University of Pittsburgh Medical Center will continue, a judge has ordered, overruling UPMC's attempts to stay the cases, according to a Pittsburgh Post-Gazette report.

Three lawsuits will move forward into discovery, beginning today. One is a 2009 antitrust suit filed by West Penn against UPMC. The other is a 2010 class-action suit filed by real estate firm Royal Mile Co. against UPMC and Highmark, claiming the two organizations were involved in a conspiracy to block competition. The third suit was added last week, when UPMC filed suit against Highmark, claiming the insurer is monopolistic.

U.S. District Judge Joy Flowers Conti has ruled that the first phase of discovery will involve millions of pages of documents and deposition transcripts. UPMC has until the end of July to produce those materials. Highmark has the same deadline, but it could be extended to mid-August based on events of the Royal Mile case, according to the report.
