Florida's Lee Memorial to Respond to Neurosurgeon's Lawsuit Over Non-Compete Clause

Fort Myers, Fla.-based Lee Memorial Health System is expected to respond to a lawsuit filed by a neurosurgeon over the non-compete clause in his contract by early next week, according to a Naples Daily News report.

Eric Eskioglu, MD, began practicing at Physicians Regional Medical Center in Naples, Fla., on April 11, but a non-compete clause in his former employment contract with Lee Memorial restricts him from engaging in neurosurgical practice within a 50-mile radius of Lee Memorial for three years after leaving the hospital — voluntarily or involuntarily.

Lee Memorial must respond to the suit by early next week. The public system may have to decide between its financial interests and well-being of patients in the area, according to the report, since Dr. Eskioglu is one of the only physicians in the region to perform minimally invasive surgeries for brain aneurysms.
