Last March, former Democratic Gov. Jim Doyle denied a request by Mr. Van Hollen to join the Florida lawsuit. The judge in the case, a Reagan appointee, is expected to issue his decision this month.
So far, two federal judges appointed by President Clinton have upheld the law’s individual mandate and one judge in Virginia, appointed by President George W. Bush, struck it down. The Obama administration will challenge the Virginia decision in the 4th Circuit Court of Appeals. The 6th Circuit is considering an appeal of one of the decisions to uphold the individual mandate.
