Wisconsin Lawmakers Propose State-Level Alternative to Individual Mandate

Wisconsin Sen. Frank Lasee is proposing an amendment to the state constitution that he says could restore consumers’ ability to opt out of the individual mandate once it goes into effect, according to a WUWM report.

Under the individual mandate, consumers who fail to purchase healthcare coverage are subject to financial penalties. Sen. Lasee said his proposed amendment would allow consumers to opt for no healthcare coverage or private healthcare coverage if they wanted, according to the report.

However, other experts believe Sen. Lasee’s proposed constitutional amendment would not yield much change. Democratic Rep. Jon Richards argued federal law is above state law, while David Riemer, the director of an anti-poverty agency, argued the healthcare reform law does not invalidate consumers’ right to purchase private health insurance.
