In April, jurors found Tuomey Hospital guilty of violating the Stark Act through employment agreements with physicians for its Outpatient Surgery Center.
The jurors had cleared the facility of $227.5 million in False Claims Act violations stemming from allegations that the hospital submitted claims resulting from referrals, which violated self-referral law. But a U.S. District Judge has said the government is entitled to a new trial regarding the False Claims Act violations after admitting he made a mistake excluding some testimony during the earlier trial, according to The Item report.
If Tuomey Hospital is found guilty of False Claims Act violations and faces a monetary penalty, there will be no double recovery.
