Momenta settles drug monopoly lawsuit with Nashville hospital for $35M

Momenta Pharmaceuticals agreed to pay Nashville General Hospital $35 million to settle a lawsuit the hospital filed in 2015 accusing Momenta of illegally monopolizing a blood clot drug, according to The Tennessean

Momenta said in a Dec. 10 filing with the U.S. Securities and Exchange Commission that the settlement will resolve all of the hospital's claims, but it is waiting for approval from a federal judge. 

Nashville General claimed in the suit that Momenta, along with Sandoz, claimed to own a patent on a drug called Lovenox, designed to prevent blood clots, after the FDA and federal courts ruled it could not be patented. 

Claiming to own a patent prevented competitors from producing generic versions of the drug and allowed Momenta and Sandoz to charge far higher prices for it. The two drugmakers collected hundreds of millions in overcharges, the lawsuit alleged. 

It is unclear whether Nashville General is negotiating a settlement with Sandoz as well, according to The Tennessean.
