UnitedHealth to SCOTUS: Back controversial billing method

UnitedHealth Group requested that the U.S. Supreme Court uphold its billing tactic of offsetting overpayments made to out-of-network providers from some of its health plans by withholding payments to the same provider from its different health plans, according to Bloomberg Law.

In a May 30 petition, the health insurance giant asked the justices to overturn a decision made by the U.S. Court of Appeals for the Eighth Circuit. In that decision, the circuit affirmed a ruling on the billing tactic, called cross-plan offsetting, in a Jan. 15 filing. The Eighth Circuit found that the practice was not allowed by UnitedHealth's plans and potentially broke federal law.

However, UnitedHealth argued the circuit failed to give UnitedHealth appropriate deference and fell on the wrong side of multiple circuit splits, according to Bloomberg.
