BCBS Association CEO to testify in court over Anthem-Cigna breakup

Blue Cross Blue Shield Association CEO Scott Serota must testify in a legal battle over the failed $54 billion Anthem-Cigna merger, according to Law 360.

Four things to know:

1. A Delaware vice chancellor made the ruling Feb. 14, which compels a testimony from Mr. Serota, who is a nonparty in the case.

2. The ruling follows a Cigna motion to require Mr. Serota to appear at the trial. In that motion, Cigna argued that Mr. Serota could offer testimony on its claims that Anthem didn't use reasonable best efforts to address antitrust concerns.

3. In February 2017, Cigna sued Anthem in Chancery Court for a termination fee, damages and costs related to the failed deal, which is estimated at $15 billion. Anthem then sued Cigna in May 2017 for about $20 billion in damages and costs.

4. The trial is set to begin Feb. 25, according to Law 360.
