Third Theranos lawsuit brings Walgreens into the mix

Another potential class action lawsuit has been slapped on top of two others against Palo Alto, Calif.-based blood testing startup Theranos — only this one also names Deerfield, Ill.-based Walgreens Boots Alliance as a defendant.

This third lawsuit, filed by Redlands, Calif.-based law firm McCuneWright — the firm that filed the first lawsuit against Theranos — is similar to its two predecessors in that it is based on allegations of false and misleading marketing. The complaint alleges Theranos and Walgreens used false advertising, unfair business practices, fraud, negligent misrepresentation and deceit.

Walgreens has a $50 million stake in the startup and hosts 40 Theranos clinics in its Arizona stores. Following reports of Theranos' lab issues, Walgreens has been seeking a way to terminate its partnership.
