A patient at Munster, Ind.-based Community Hospital alleges that her X-rays were illegally shown to her employer, according to The Indiana Lawyer.
Amanda Henry sought out medical treatment at the hospital in March 2018. After receiving X-rays, she says her employer showed her digital images of her scans on the employer's cell phone.
According to the complaint, Ms. Henry's employer is married to the radiologic technician who performed the X-rays on her.
Ms. Henry filed a complaint against Community Healthcare System and Community Hospital, claiming that the health system had a duty to protect her privacy, security and confidentiality, according to The Indiana Lawyer. However, a trial court originally dismissed Ms. Henry's complaint.
Most recently, an appellate court reversed the trial court's decision, noting an "age-old recognition that medical providers owe a duty of confidentiality to their patients."
