Judge Denies Dr. Mark Midei's Appeal to Reinstate Medical License

Cardiologist Mark Midei, MD — who lost his medical license over allegations of unnecessary stenting in 2011 — will not be able to reinstate his license to practice in Maryland after a Baltimore County judge denied his appeal, according to a Baltimore Sun report.

Circuit Court Judge Susan Souder said the Maryland Board of Physicians' decision to revoke Dr. Midei's license in 2011 "is not arbitrary or capricious" and "shall be affirmed," according to the report. Dr. Midei said he is "disappointed deeply" with the judge's decision and that he remains "certain of the soundness of [his] medical decisions," according to the report.

Recently, Dr. Midei's defamation lawsuit against St. Joseph Hospital in Towson, Md., was dismissed. The suit sought $60 million in compensatory damages and up to $540 million in punitive reparation. Dr. Midei claimed the hospital set up him up as a scapegoat to distract regulatory attention from a separate kickback scheme, in which he claims the hospital was involved. Dr. Midei was forced to resign from St. Joseph Hospital in 2009.

Dr. Midei can apply for medical license reinstatement in mid-2013, according to the report.
