Henry Ford Health Settles Alleged Violation of Americans With Disabilities Act

Henry Ford Health System in Detroit has settled a complaint with the Department of Justice, resolving allegations that the hospital system failed to provide sign language interpreters to a deaf patient, according to a DOJ news release.

The complaint alleged that the system had violated the Americans with Disabilities Act when it failed to provide appropriate aids and services to a deaf patient and his deaf family members at Kingwood Hospital in Ferndale, Mich. A DOJ review of the system concluded that systems were not adequately ensuring deaf and hard-of-hearing patients access to auxiliary aids and services to guarantee communication throughout their medical treatment.

Under the settlement, the health system will be required to train hospital staff on the requirements of the ADA, adopt specific policies and procedures to ensure auxiliary services and aids to deaf or hard-of-hearing patients and appoint a corporate ADA administrator and ADA facilitators at each hospital within the system. Henry Ford will also be required to pay $70,000 to family members who were denied effective communication under this settlement.
