Federal Judge Dismisses Nevada Patient-Dumping Suit

Staff -

A federal judge has dismissed suit Rawson-Neal Hospital in Las Vegas that had accused the psychiatric hospital of giving patients one-way tickets to California, according to an article in the Las Vegas Sun.

The suit, filed by the American Civil Liberties Union, seeks class-action status for as many as 1,500 patients allegedly bused out of state by the hospital without a care plan or place to stay, according to the suit.

However, U.S. District Court Judge James Mahan ruled the "complaint does not establish that he was compelled to leave the stateā€¦ merely that defendants gave him the resources by which to do so," according to the report.

Judge Mahan's dismissal does allow the ACLU to re-file the case, and a representative from the organization says the ACLU intends to, according to the report.
