In a policy issued May 7, the Department of Justice identified the factors that will be considered and the credit that will be offered to companies or individuals who cooperate with False Claims Act investigations.
Under the policy, cooperation credit can be earned in several ways, including by voluntarily disclosing misconduct and taking proper remedial actions in response to a False Claims Act violation.
Most frequently, the Justice Department rewards cooperation by reducing the penalties or damages sought in a case.
"The Department of Justice has taken important steps to incentivize companies to voluntarily disclose misconduct and cooperate with our investigations; enforcement of the False Claims Act is no exception," Assistant Attorney General Jody Hunt said in a press release.
